NYC DWI Attorney Discusses Getting Pulled Over
As an experienced NYC DWI Attorney I am often asked what one should after they have been pulled over and they have been drinking. If you get pulled over in New York City and a police officer asks if you’ve been drinking, it’s a very sticky situation because you don’t want to lie. When you lie, you get nervous. When you lie, it appears that you’re hiding something. That can lead to a whole host of problems that you have with the police. Clearly, if you’ve been drinking and you’re 21 or above, you’re permitted by law to consume alcohol and drive an automobile.
The question really is, is your ability impaired? Are you legally intoxicated? You could have blood shot watery eyes, you could have an odor of alcohol and still not be impaired. I cannot tell you, nor would I tell you, to lie to a police officer. That probably puts things in motion in a very poor way if you’re pulled over in the city of New York.
