New York DWI Lawyer Discusses Police Checkpoints
As an experienced NYC DWI Lawyer I am regularly asked what one should do if they drive into a police checkpoint. If you’re driving around New York City, and you come upon a checkpoint and you don’t want to go through the checkpoint, very often they have a chokepoint. A chokepoint is a space that doesn’t allow you to turn around, so you’re snagged in the checkpoint. If you have an opportunity to not be part of a check point and you turn back around, sometimes they have chase cars that will chase a car that turned away from a checkpoint.
That would be a very interesting case to determine whether or not there was probable cause to stop someone who did veer away from a checkpoint. Generally speaking, most people are snagged into the checkpoint, and that’s how I get to meet them when they’re charged in Manhattan with a DWI.
