New York DWI Lawyer Discusses Having Passengers in Your Car During a DUI Arrest
As an experienced New York DWI Lawyer, I am often asked how having passengers in your car during a DUI stop can help. Anybody that’s with you at the time that you’re charged with a DWI in the State of New York is a potential witness. I view it as your witness; someone that might be able to help us defend you. Very often, they would be able to observe whether or not there was any aberrant driving or any traffic infraction and could testify to that. They were there, and they could hear the way the police officer communicated with you, what you said to the police, and what the police officer said to you. Most of the time, field sobriety tests are not done on the street in NYC. A passenger can be very, very useful, and I would like very much to speak to each and every one of them on your behalf. If they don’t prove to be useful, then we won’t use them, but it’s important to speak to them for any defense.
