New York DWI Attorney Discusses Mistaken Identity in a DUI Accident
As an experienced New York DWI Attorney I have handled cases where someone was charged with a DWI but they were not operating the motor vehicle. I recently took on a case where there was an accident and the only “witness” to who was operating the car was another driver, in another vehicle who was involved in that accident. The police arrived on the scene sometime later. The police were investigating the incident and they spoke to all the parties. The driver of the other vehicle points out my client as the driver, but they were mistaken.
We have the opportunity to defend you based on a mistaken identification. That’s something that can be resolved either in a pre-trial hearing or also at a trial. There might be several people who could have operated that motor vehicle and if you were not that person, you have the right to defend yourself against a DWI where you were not operating the motor vehicle. As an experienced New York DWI Attorney, I have successfully done that for clients in the past.
