As an experienced New York DWI Attorney I am often asked by my clients how to get a hardship license once they are arrested for a DWI.
- If your BAC was .08 or more, or have refused a breathalyzer, the judge will suspend your license.
- If you have refused a breathalyzer, you will not be able to get a hardship license.
- If you live outside of the city, you must show that you financially require a hardship license and can not afford to hire a driver.
- If you live in NYC, it is much more difficult to acquire a hardship license because of easy access of public transportation.
