New York City Theft Charges | Shoplifting
In New York, when you’re charged with shoplifting, you’re actually charged with a Petit Larceny. It’s a Penal Law violation, it’s a crime, and it will be prosecuted by the prosecutor’s office in whatever county you’re in. In some counties, they very vigorously prosecute those charges. Other prosecutors are more interested in diversion and helping that person so they will not commit that crime again.

A juvenile that’s charged in New York would be prosecuted depending on the severity of the charge either in the family court or the criminal court. If it’s a low-level theft, it would be handled in the family court. While they’ll be prosecuted, their likelihood of being severely punished is limited to their age and the severity of the crime.
