If you get arrested for driving while intoxicated, DWI, DUI, in New York City, Manhattan, and you go before the judge for the initial arraignment, if your blood alcohol content was a .08 or more, you’ll be suspended while the case is pending. If you had refused to take a breath test, then you will get suspended by the judge and have to report to a Department of Motor Vehicles Chemical Refusal hearing within 15 days of the arraignment.
