Manhattan DWI Attorney Discusses Field Sobriety Tests
As an experienced Manhattan DWI Attorney I am often asked about sobriety tests. People that are arrested in New York City and charged, let’s say, in Manhattan are going to be asked to withstand their field sobriety tests. If you’re arrested in Manhattan specifically, they’ll probably ask you to do that in the police department. It’ll be videotaped on most accounts, and there will be a recording of it. If you wish to refuse to give consent to give field sobriety tests, you may do so. You’ll be recorded doing so. You have to be aware that your refusal to take the test will be recorded.
However, if you know that you’re not going to do well, it’s probably best not to do them at all. If you are upset that you’ve been arrested but you’re otherwise sober, it would be a great opportunity to prove that you’re sober. By the time you’ve see the recording, you’ll probably have already made that decision. Either way, we’ll get the videotape and we’ll analyze it.
