DWI Entitled Rights | Entitled to a DWI Trial
If you’re charged with DWI or DUI in the state of New York, it is important to know that you are entitled to a trial. There’s no judge, prosecutor, or attorney on this earth who can take away your right to a trial where the prosecutor is required to prove each and every element of the charge or charges beyond a reasonable doubt. Also, you do not have to testify at that trial – and the fact that you do not testify can’t be held against you. When you call me about your case, I will ask you a series of questions and begin preparing your case for trial from the very outset.
DWI Entitled Rights | Entitled to Review All DWI Evidence
If you’ve been charged with DWI or DUI in the state of New York, you are entitled to certain discovery rights. If you’ve been videotaped during any part of your case – perhaps the car stops or perhaps the field sobriety test – you’re entitled to see those videos. If the prosecutor filed any documents with the court, you’re entitled to see those documents. If a breath testing device was used to measure your breath, you’re entitled to see the certifications and certificates from the machine used to test you. Please know that, when I represent an individual charged with DWI, I demand access to every piece of evidence for review with my client before proceeding to trial.
